Restful Pump®, Inc. Terms and Conditions

These are the Terms and Conditions of the Restful Pump® Chair Programs (“Programs”) of Restful Pump®, Inc. (“Restful Pump®,” “we,” “us,” and “our”) governing product usage, rental, purchase and/ or feedback programs Restful Pump® sponsors from time to time.

Please carefully review these Terms. By clicking [ I have read and agree to the terms and conditions] on RestfulPump.Shop, RestfulPump.com or otherwise participating (as a ‘Participant’) in the usage (as a ‘User’) of Restful Pump® Products, you acknowledge that you accept these Terms and Conditions. If you do not accept these Terms and Conditions, you may not participate in any Restful Pump® Program(s) or be a user of Restful Pump® Products.

These Terms & Conditions explain (i) how the Rental Program will be conducted (‘lease’ and ‘rent’ or ‘rental’ terms may be used interchangeably), (ii) terms and conditions relating to your participation, or other programs, (iii) what information, including Personal Information (as defined below), we or our third-party agents might collect in connection with Restful Pump® Programs, and (iv) how we or our third-party agents will use that information.

The terms ‘Damage’ or ‘Damaged’ refers to broken, defaced, impaired, displays graffiti, food or other stains, not functional as originally intended, no longer in original state, may not be used properly or effectively or efficiently.

Please also review our Privacy Policy available on our website (restfulpump.shop) (our “Website”), which further explains how we collect and use your Personal Information (as defined below), when you access or interact with our Website, or participate in a Rental, or other Programs and the choices you can make about that Personal Information.

Restful Pump® Programs

  • Participant understands rental options can be viewed and purchased on RestfulPump.Shop or directed by RestfulPump.com to RestfulPump.Shop. 
  • Participant understands to contact Restful Pump® at info@RestfulPump.com if there is an issue with the unit during the first set up or first use.
  • Participants will contact Restful Pump® at info@RestfulPump.com with any concerns about positioning or usage questions with any part of the chair as soon as they are able. 
  • Participants understand and agree that the Restful Pump® Chair and Table are not designed for the baby to be rested on. Do not place your baby on the Restful Pump® Chair and Table.
  • Participants understand and agree that the Restful Pump® Chair is engineered to facilitate gravity during a pump session and is not intended to replace a bed for a full night’s sleep. 
  • Participants understand that payment information is kept on file.
  • Participants understand that they must maintain a valid email and phone number in their account.

Failure to Return Leased Unit 

Participants understand that if proof of unit return is not shared on at Accounting@RestfulPump.com within 30 days after their last payment has been received, they will be charged the full MSRP (manufacturer suggested retail price) of $1,999 per chair.

Example:

User pays for a 3-month rental from July 15th – October 15th.  

  1. Month 1 = July 15th to August 15th 
  2. Month 2 = Aug 15 – Sept 15th
  3. Month 3 = Sept 15th – October 15th. This concludes the 3-month rental period.

The above example chair rental is expired on October 16

In this instance, the user has several options…

  1. Log onto their account, register to extend the rental an additional 3-months, BEFORE the rental term expiration of October 15th, which earns them free return shipping after their second 3-month term.
  2. Extend the rental to another 6 months, BEFORE the rental term expiration of October 15th. 6-month rentals earn free return shipping.
  3. Return the unit*
  4. *If the user does not send a proof of return receipt to Accounting@RestfulPump.com before November 15th, the user will be charged for the entire unit, $1,999 plus applicable fees such as taxes, processing fees or other.

Eligible users understand that in order to avoid unnecessary charges, users are urged to register for extended rentals or eligible monthly subscriptions as soon as possible in the last month of rental or after receipt of the reminder email.

  1. Participant understands to extend a rental online on RestfulPump.Shop. This transaction must be completed before the last day of their last paid rental period.

Normal Wear and Tear: Participants returning their Restful Pump® Chair and attached accessories may receive all or most of their security deposit back if the unit presents with ‘normal wear and tear’. This includes but may not be limited to:

  1. Upper Assembly and components are not damaged. This may include:
    1. Bottle holders
      1. The bottle holders lock into various positions, are not broken.
      2. Bottle Slider Rods are not damaged.
      3. T-Bar accessory rod is included in the return and functions to snap on and stay in place on the Center Base Post and is now damaged.
    2. Bottle slider rods are not damaged
      1. bottle slider functioning in a smooth manner on the rod.
    3. Table
      1. Folds down all the way after engaging the locking/unlocking mechanism.
      2. Locks into the 2 offered horizontal positions with single or double handed easy adjustments.
      3. Is not damaged, scratched, cracked, with graffiti, food spills or stains.
    4. Headrest
      1. The headrest is still functional, locks into place, can be adjusted up and down in the post and with depth from the side adjustments.
    5. Chest support frame, adjustable pelvic support, seatbelt
      1. Lock into place, stay in place with use
      2. Support the user for extended periods >30min per usage.
    6. Seatbelt easily clicks into place, is not damaged, does not have rips, tears, defacement, or missing parts.
      1. Seatbelt may be stored away with the pelvic support and stay stored away, as intended.
  2. Lower Assembly and components are not damaged. This may include:
    1. Base of the unit
      1. The seat is not broken.
      2. There is little to no damage (intentional or otherwise) to the base of the unit, cross-bar legs, feet on the cross-bar legs, foot rests on the cross-bar legs or other lower base structures or components.
    2. General Function of the unit
      1. The unit can be disassembled for travel.
      2. The unit can be set up to safely use in the two functional forward leaning seated positions.
  3. Mechanical
    1. The rotating crank handle works to move the unit into positions, smoothly, without problems or locking into an undesired position.
  4. Upholstery
    1. There are no rips or damage in upholstery or cushions.
    2. The forward leaning center base pneumatic adjustable post is functioning and adjustable (up and down and forward to upright) without missing pieces, locks into place, stays into place, etc.

Return of Security Deposit 

  • Participants understand that portions of the security deposit may be used to repair missing or broken components if the unit is returned in a condition other than ‘normal wear and tear’.
  • Participant understands that return of user’s security deposit will be determined after receipt of the unit and assessment of the ‘wear and tear’ condition of the returned unit and components. 
  • Participant understands there is a warrantee program to add to their registration at check out when ordering a Restful Pump product. 

Commercial or Retail Purchase or Bulk Sale

  • Purchases for Professional Buildings and/or Commercial Building Lactation Suites, and other may contact CommercialSales@RestfulPump.co.
  • Purchases for Professional Buildings and/or Commercial Building Lactation Suites, and other, must agree to the Restful Pump Commercial Sales Terms & Conditions. 
  • Purchasers that no longer wish to keep or use Restful Pump® products understand to contact Restful Pump for the Buy-Back-Program regarding their unwanted product Buy Back, or for details with returning a unit(s) to upgrade to a new unit(s).

Rev-Share Program Participants

  • Retailers, Lactation Consultants and/or other appropriate professionals that are interested in the Rev-Share Program understand that they may contact Info@RestfulPump.com
    with questions or concerns. 
  • Rev-Share participants understand that they must agree to the Program Terms and Conditions.

Shipping

  1. User pays for initial and return shipping with a 3-month chair rental
  2. User earns free return shipping with any rental totaling 6+ months
  3. Retailers may offer return procedures for Restful Pump

Contact your Restful Pump for return address or your local retailer of Restful Pump products to learn more.

Participants and professionals in the lactation space understand they may reach out to schedule a Zoom (or other) call with Restful Pump® staff to address usage of the chair.

Participants of any Restful Pump® Program understand to email the Customer Service Department at info@restfulpump.com
 or call or text (978) 737-8385 if there are questions or concerns of the unit as soon as they are able.

Extend the rental: Same as above. Participants understand to extend the rental in their RestfulPump.Shop account within the last month of agreed upon rental to extend the rental BEFORE the end of the rental period. 

Intellectual Property

As between Restful Pump® and the Participants, Restful Pump® owns all right(s), title, and interest, including all intellectual property rights, in the Products and any given Feedback.

WAIVER

BY AGREEING TO THESE TERMS AND CONDITIONS, PARTICIPANT CONFIRMS PARTICIPANT’S UNDERSTANDING THAT THIS CURRENT OFFERING FROM RESTFUL PUMP AND THE FEEDBACK PROGRAM IS USING NEW PRODUCT DESIGNS AND/OR FIRST-TO-MARKET PRODUCTS THAT MAY NOT HAVE BEEN TESTED BY OTHER HUMANS. PARTICIPANT ASSUMES ALL RISK IN PARTICIPANTING IN RESTFUL PUMP OFFERINGS AND/OR THE FEEDBACK PROGRAM, INCLUDING RISK OF BODILY HARM OR DEATH, AND RESTFUL PUMP DISCLAIMS ALL LIABILITY TO PARTICIPANT OR ANY OTHER PERSON ARISING FROM PARTICIPANT’S PARTICIPATION IN THIS FEEDBACK PROGRAM. 

THE PRODUCTS ARE PROVIDED “AS IS” AND RESTFUL PUMP HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, RELATING TO THE PRODUCTS OR ANY FEEDBACK PROGRAM. RESTFUL PUMP SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RESTFUL PUMP MAKES NO WARRANTY OF ANY KIND THAT ANY PRODUCTS WILL BE FREE FROM DESIGN OR MANUFACTURING DEFECTS.

Governing Law

These Restful Pump® offerings and/or Programs are governed by and construed in accordance with the laws of the State of Massachusetts without giving effect to any choice or conflict of law provision.

Privacy

  1. Your Privacy: We respect your right to privacy. We will not sell your personally identifiable information to, or otherwise share it with, any third parties without your prior written consent. We ask that you only share information, feedback, and other materials (such as photos and video) with us directly, that we explicitly ask you for and that you would be comfortable sharing publicly. While we do not intend to share or disclose your information publicly, unless agreed upon, we cannot guarantee that the platforms through which you share will be entirely secure and confidential.

What is Personal Information?

“Personal Information” means any information that uniquely identifies an identified or identifiable natural person, such as first and last name, address, email address, and other types of contact information. An identifiable natural person is a person who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.

What Personal Information Do We Collect and How Do We Collect It?

When (i) accessing or interacting with our Website(s), (ii) signing up to participate in any Feedback Program (whether through our Website, email or a third-party provider’s website) and (iii) participating in a Feedback Program and/or renting or purchasing Restful Pump Products, you may be asked to provide us with certain Personal Information. For example, when signing up to participate in a Feedback Program, you may be asked to provide your contact information (e.g., name, phone number, email address, zip or postal code, etc.).

In addition, when providing Feedback, your Feedback may include sensitive health information or other Personal Information. Restful Pump® may provide Feedback (i) to third-party engineering and/or manufacturing firms (“Third-Party Design Firms”) who will use Feedback to improve the design, user experience and other features of the Products and (ii) to certain other third-party advisors, including legal advisors, who are assisting Restful Pump® with its business, product development and commercialization efforts (the “Purpose”). From time to time, Restful Pump® may also engage Third-Party Design Firms and other third-party partners and/or service providers (collectively, “Service Providers”) to run or host all or a portion of Feedback Programs on Restful Pump’s® behalf and to collect Feedback directly from Participants. In such instances, Participant agrees that such Service Providers will possess or have access to Feedback and Personal Information, including without limitation, Participant and/or customer names and email addresses.
