Restful Pump®, Inc. Terms and Conditions
These are the Terms and Conditions (“Generation 1.0 RPC Feedback Program and Rental Program”) of Restful Pump®, Inc. (“Restful Pump,” “we,” “us,” and “our”) governing product evaluation, usage, rental and/ or feedback programs Restful Pump® sponsors from time to time (“Generation 1.0 RPC Feedback Program and Rental Program”) for the purpose of enabling lactating women to evaluate, and provide feedback regarding, Restful Pump’s® lactation chair(s), known as the Restful Pump® Chair(s), as well as Restful Pump’s® Stand Alone Table(s) and other related products developed or in-development by Restful Pump® (“Products”). Women who participate in any Restful Pump®, Inc. Feedback Program are hereinafter referred to as “Participants”.
Please carefully review these Terms. By [clicking “I ACCEPT THE GENERATION 1 .0 RPC Feedback Program and Rental Program TERMS”] on restfulpump.shop, restfulpump.com or otherwise participating in the Feedback Program or other usage of Restful Pump Products, you acknowledge that you accept these Terms and Conditions. If you do not accept these Terms and Conditions, you may not participate in any Restful Pump® (fee reduced) Feedback or other Program(s).
This Generation 1.0 RPC Feedback Program explains (i) how a Feedback Program will be conducted, (ii) terms and conditions relating to your participation in a Feedback Program or other programs, (iii) what information, including Personal Information (as defined below), we or our third-party agents might collect in connection with a Feedback Program, and (iv) how we or our third-party agents will use that information.
Please also review our Privacy Policy available on our website (restfulpump.shop) (our “Website”), which further explains how we collect and use your Personal Information (as defined below) when you access or interact with our Website or participate in a Feedback Program, or other programs and the choices you can make about that Personal Information.
Engineering, research, and development of the Restful Pump® product line continues to evolve and be refined. If participating in the Feedback Program, candid and consistent feedback is appreciated through a survey 1x daily , 4 consistent weeks. The survey offers streamlined content collection, also with an open section for free writing. Our goal is to provide the most functional and comfortable forward leaning positioning system for hands free breast pumping.
How will the Generation 1.0 RPC Feedback Program be Conducted?
- Participants will sign up to participate in the Generation 1.0 RPC Feedback Program by securing their Restful Pump® Chair with a deposit on RestfulPump.shop, under Restful Pump Chair Reservation. This may also be found by clicking on the top right menu button, ‘Order Now’, on RestfulPump.com.
- Participants must create an account, where they are able to order, manage their orders and link to the Feedback Program Survey.
- Participants of the Generation 1.0 Restful Pump® Chair Feedback Program must agree to provide daily feedback for four consecutive weeks in their account online by a survey and free writing space for the reduced fee.
- Participants expectations:
- Participants will use their own breast pump and accessories.
- Participants agree to have a Zoom call with Restful Pump staff and associates before installation and use of the chair.
- Participants understand to email the Customer Service Department at info@restfulpump.com or call or text (978) 737-8385 if there are questions or concerns of the unit as soon as they are able.
- Participants understand they need to notify the Returns Department of Restful Pump® by email at info@restfulpump.com 30 days prior to ending their rental of the unit to request a return label and avoid unnecessary charges.
- Participants understand that portions of the security deposit may be used to repair missing or broken components if the unit is returned in a condition other than ‘normal wear and tear’ There may be acceptations for this Generation 1.0 RPC Feedback Program.
- Participants understand to take care when handling the Generation 1.0 Feedback Program units, as they may contain delicate 3-D printed components.
- Participants will contact Restful Pump® with any concerns or if not able to perform task necessary to provide feedback.
- Participants understand and agree that the Restful Pump® Chair and Table are not designed for the baby to be rested on. Do not place your baby on the Restful Pump® Chair and Table.
- Participants understand and agrees that the Generation 1.0 Restful Pump® Chair is engineered to facilitate gravity during a pump session and is not intended to replace a bed for a full night’s sleep. Feedback Users, General Users, (Rental or Purchase) participants should use caution when resting.
- Warrantee Program may be offered for retail purchases at a later date.
- Feedback Expectations
- Participants must provide feedback in the upright position of the RPC, resting with the headrest on or multitasking with the headrest off without a pump bra. Sit on the chair and use a breast pump consistently or power pump for at least a full pump session or 30 minutes, whichever is longer.
- Participants must provide feedback in the forward, leaning position of the RPC, resting with a Headrest on without a pump row. Sit on the chair and use a breast pump consistently or power pump for at least a full pump for at least a full pump session or 30 minutes, whichever is longer.
- Participants must fill out our survey in their account for streamlined feedback collection, but also may provide free writing feedback.
- Participants must indicate what number Generation 1.0 chair they are using in their original registration form. (There will be a number associated with each unit.)
- A total amount of $275.00 is due when Participants reserve their chair, $200.00 of which is a one-time security deposit and the remaining $75.00 of which covers the first rental payment (a more than 50% discount to standard monthly rental rates). Please share the date you would like your chair to arrive at your chosen destination.
- After the first 4 weeks (at least 28 consecutive days), Participants can choose to return the unit and its components or continue to rent the chair at a cost of $200 / month per unit without providing additional feedback.
- Units used for the Feedback Program must be returned at the end of your subscription. If you are interested in purchasing the chair, then contact customer support at info@restfulpump.com.
- Participants understand that units not returned within 30 days after their last auto pay subscription runs out will be charged the full MSRP (manufacturer suggested retail price) of $2,500, regardless of rental term and rent paid.
- Normal Wear and Tear: Participants returning their Restful Pump® Chair and attached accessories may receive all or most of their security deposit back if the unit presents with normal wear and tear. This includes:
- The bottle sliders and bottle holders are functioning and are not broken.
- The seat is not broken.
- The unit still folds up for travel or can be set up to safely use in the two functional seated positions.
- The headrest is still functional.
- There are no rips in the upholstery.
- The forward leaning center adjustable post is functioning and adjustable (up and down and forward to upright) without missing pieces.
- The chest support and extendable core support are functioning.
- There is little to no damage (intentional or otherwise) to on the unit base or other components.
- The adjustable table of the chair functions and locks into place, without damage.
- Participants agrees to seek written approval from Restful Pump® prior to sharing or posting any images, videos, testimonials, thoughts, comments, statements, or any posts on any platforms such as online, on any computer, any phone, or any digital device.

- Your Privacy: We respect your right to privacy. We will not sell your personally identifiable information to, or otherwise share it with, any third parties without your prior written consent. We ask that you only share information, feedback, and other materials (such as photos and video) with us directly, that we explicitly ask you for and that you would be comfortable sharing publicly. While we do not intend to share or disclose your information publicly, unless agreed upon, we cannot guarantee that the platforms through which you share will be entirely secure and confidential.
Engineering and R&D purposes Social Media and Marketing
I agree to share my likeness in photos and videos to Restful Pump®, Inc. through the restfulpump.shop platform within my account at my choosing.
U.S. Participants Only
Only U.S. residents are authorized to participate in the limited quantity, Generation 1.0 RPC Feedback Program.
Feedback
As described above, as part of the Generation 1.0 RPC Feedback Program, Participants are required to provide once daily Feedback to Restful Pump® regarding the Products. All feedback, comments, suggestions, recommendations or the like provided by Participants, whether provided orally, electronically or in writing, or other, relating to the Products, including suggestions regarding design or functionality improvements or new features (“Feedback”), shall be exclusively owned by Restful Pump,® Inc. Subject to these Generation 1.0 RPC Feedback Terms, Restful Pump® is free to use such Feedback in any manner without any attribution or compensation to any person, including Participants. The Participant, by agreeing to these Terms and Conditions, hereby assigns to Restful Pump® all right(s), title, and interest in the Feedback and in any ideas, know-how, concepts, techniques, or other intellectual property rights, and/or other, contained in the Feedback, in all respects. Notwithstanding the foregoing, Restful Pump® is not required to use the Feedback.
Intellectual Property
As between Restful Pump® and the Participants, Restful Pump® owns all right(s), title, and interest, including all intellectual property rights, in the Products and the Feedback.
WAIVER
BY AGREEING TO THESE TERMS AND CONDITIONS, PARTICIPANT CONFIRMS PARTICIPANT’S UNDERSTANDING THAT THIS CURRENT OFFERING FROM RESTFUL PUMP AND THE FEEDBACK PROGRAM IS USING NEW PRODUCT DESIGNS AND/OR FIRST-TO-MARKET PRODUCTS THAT MAY NOT HAVE BEEN TESTED BY OTHER HUMANS. PARTICIPANT ASSUMES ALL RISK IN PARTICIPANTING IN RESTFUL PUMP OFFERINGS AND/OR THE FEEDBACK PROGRAM, INCLUDING RISK OF BODILY HARM OR DEATH, AND RESTFUL PUMP DISCLAIMS ALL LIABILITY TO PARTICIPANT OR ANY OTHER PERSON ARISING FROM PARTICIPANT’S PARTICIPATION IN THIS FEEDBACK PROGRAM.
THE PRODUCTS ARE PROVIDED “AS IS” AND RESTFUL PUMP HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, RELATING TO THE PRODUCTS OR ANY FEEDBACK PROGRAM. RESTFUL PUMP SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RESTFUL PUMP MAKES NO WARRANTY OF ANY KIND THAT ANY PRODUCTS WILL BE FREE FROM DESIGN OR MANUFACTURING DEFECTS.
Governing Law
These Restful Pump offerings and/or the Generation 1.0 RPC Feedback Programs are governed by and construed in accordance with the laws of the State of Massachusetts without giving effect to any choice or conflict of law provision.
What is Personal Information?
“Personal Information” means any information that uniquely identifies an identified or identifiable natural person, such as first and last name, address, email address, and other types of contact information. An identifiable natural person is a person who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.
What Personal Information Do We Collect in connection with Generation 1.0 RPC Feedback Program and How Do We Collect It?
When (i) accessing or interacting with our Website(s), (ii) signing up to participate in a Generation 1.0 RPC Feedback Program (whether through our Website, email or a third-party provider’s website) and (iii) participating in a Feedback Program and/or renting or purchasing Restful Pump Products, you may be asked to provide us with certain Personal Information. For example, when signing up to participate in a Feedback Program, you may be asked to provide your contact information (e.g., name, phone number, email address, zip or postal code, etc.).
In addition, when providing Feedback, your Feedback may include sensitive health information or other Personal Information. Restful Pump® intends to provide Feedback (i) to third-party engineering and/or manufacturing firms (“Third-Party Design Firms”) who will use Feedback to improve the design, user experience and other features of the Products and (ii) to certain other third-party advisors, including legal advisors, who are assisting Restful Pump® with its business, product development and commercialization efforts (the “Purpose”). From time to time, Restful Pump® may also engage Third-Party Design Firms and other third-party partners and/or service providers (collectively, “Service Providers”) to run or host all or a portion of a Generation 1.0 RPC Feedback Programs on Restful Pump’s® behalf and to collect Feedback directly from Participants. In such instances, such Service Providers will possess or have access to Feedback and Personal Information, including without limitation, Participant and/or customer names and email addresses.
